1. Introduction
These Terms of Service (the “Terms”) are a legal agreement between you (“Client,” “User,” or “You”) and Limi Landscaping LLC(“Limi Landscaping,” “Company,” “We,” “Our,” or “Us”), a Massachusetts limited liability company. By requesting, purchasing, or using our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.
2. Services Provided
Limi Landscaping provides landscaping, lawn care, hardscaping, maintenance, seasonal cleanups, snow removal, and related outdoor property services. All services are delivered in accordance with industry standards and are subject to availability, scheduling, and weather conditions.
3. Client Responsibilities
- You agree to provide accurate information required to perform the services.
- You agree to provide safe access to your property and notify us of any hazards or restrictions.
- You agree to comply with all applicable local, state, and federal laws and regulations related to the services.
- You are responsible for obtaining any required permits, HOA approvals, or property-owner authorizations.
4. Estimates and Pricing
Estimates are provided based on the property condition and scope of work discussed at the time of the estimate. Material price changes, scope changes, or property conditions that differ materially from those described may result in price adjustments, which will be communicated before work proceeds.
5. Payments
- Payments must be made as agreed in your service contract or invoice.
- Late payments may incur fees, interest, or suspension of services.
- All fees are non-refundable unless otherwise stated in writing by the Company.
6. Cancellations and Rescheduling
You may cancel or reschedule services with reasonable advance notice. Weather-related rescheduling will be coordinated by our team and is not subject to cancellation fees. Same-day cancellations for confirmed appointments may incur a fee covering crew time.
7. Limitations of Liability
- Limi Landscaping shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.
- Our total liability for any claim is limited to the amount paid for the specific service giving rise to the claim.
- We are not responsible for delays or damages caused by weather, natural disasters, accidents, or events beyond our reasonable control.
- We are not responsible for damage to unmarked sprinkler heads, underground wiring, invisible fences, or property features not disclosed prior to service.
8. Insurance
Limi Landscaping carries general liability insurance. Certificates of insurance are available upon request for commercial clients.
9. Intellectual Property
All promotional materials, logos, website content, photographs of completed work, and service descriptions remain the intellectual property of Limi Landscaping. Users may not reproduce, copy, or distribute them without written permission.
10. Termination
Either party may terminate this Agreement with written notice. Limi Landscaping reserves the right to terminate services immediately if the Client breaches these Terms or fails to pay outstanding invoices.
11. SMS Communications
By providing your phone number, you may receive text messages from Limi Landscaping regarding appointment reminders, follow-up messages, and billing inquiries. See our SMS Terms for details on consent, frequency, and opt-out.
12. Privacy
Your information is handled in accordance with our Privacy Policy.
13. Governing Law
These Terms are governed by and construed under the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Massachusetts.
14. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when the Terms were last revised. Continued use of our services after changes constitutes acceptance of the updated Terms.
